Terms of Use

These Terms of Use ("Terms") govern your participation in FocusNest, a homeowner focus group program operated by FocusNest ("we," "us," or "our"). By applying to participate or attending a session, you agree to these Terms. If you do not agree, please do not apply or participate.

1. Acceptance of Terms

By submitting an application, attending a FocusNest session, or using any part of our website or program, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

If you are applying on behalf of a household, you represent that you have authority to agree to these Terms on behalf of other household members participating in the program.

2. What FocusNest Is

FocusNest organizes small-group focus sessions where homeowners share opinions and experiences about home services — topics like HVAC, windows, roofing, insulation, and similar projects. Sessions are educational and conversational in nature.

FocusNest is not a marketplace, contractor referral service, or lead generation platform. Attending a session does not create any obligation to purchase products or services, and we do not guarantee or endorse any service provider, product, or contractor.

Connections to local service providers are available only when you explicitly opt in and are provided as a convenience, not as part of the core program. Participation in focus sessions is entirely separate from any optional provider connections.

3. Eligibility

To participate in FocusNest sessions, you must:

• Be at least 18 years of age
• Be a current homeowner (own and reside in a home, condo, townhome, or similar property)
• Reside in a geographic area where FocusNest sessions are currently available
• Provide accurate and truthful information in your application

We reserve the right to verify eligibility and to decline or remove any applicant who does not meet these requirements.

4. Participation Expectations

Focus sessions work best when everyone contributes honestly. By participating, you agree to:

• Engage in good faith and share your genuine opinions and experiences
• Attend sessions you have confirmed and notify us promptly if you need to cancel
• Treat other participants and session facilitators with courtesy and respect
• Keep session-specific content (such as product concepts or pricing shared under confidentiality) private unless otherwise instructed

5. No Guarantee of Session Placement

Applying to FocusNest does not guarantee participation in a session. Session invitations are issued based on availability, geographic fit, session topic relevance, and current participant needs. We may not be able to place every applicant, and there is no obligation on our part to offer sessions to every person who applies.

If you are matched to a session and cannot attend, please let us know as early as possible so we can offer your spot to another homeowner.

6. Prohibited Conduct

To protect the integrity of our sessions and the experience of all participants, the following conduct is prohibited:

• Submitting false, misleading, or fabricated information in your application or during a session
• Misrepresenting your homeownership status or eligibility
• Disrupting, harassing, or behaving inappropriately toward other participants or staff
• Attempting to use FocusNest sessions to solicit other participants for commercial purposes
• Recording sessions without prior written permission
• Attempting to circumvent reward or eligibility systems (see Reward Terms)

Violation of these rules may result in removal from the current session, disqualification from future sessions, and forfeiture of any pending rewards.

7. Limitation of Liability

FocusNest provides its program "as is" and makes no warranties, express or implied, about uninterrupted availability, session outcomes, or results from optional service provider connections. To the fullest extent permitted by law, FocusNest and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your participation in the program or use of our website.

Our total liability to you for any claim arising from these Terms shall not exceed the value of any reward you received in connection with the session at issue.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued participation in FocusNest after changes are posted constitutes your acceptance of the revised Terms. If changes are material, we will make reasonable efforts to notify active participants by email.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Illinois, and you consent to personal jurisdiction in those courts.
